Welcome to LeetHire. These Terms of Service ("Terms") govern your access to and use of the LeetHire website and services. Please read these Terms carefully before using our services. By accessing or using the Service you agree to be bound by these Terms.
1. Definitions of Key Terms
In these Terms, "we," "us," "our," and "LeetHire" refer to the platform operator. "User," "you," and "your" refer to any individual or entity using our services, including both "Talent" (IT professionals) and "Companies" (potential employers).
2. User Accounts & Responsibilities
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your password and for all activities that occur under your account.
3. Services for Companies
Companies can use LeetHire to browse anonymous profiles of tech talent. By engaging with a candidate, you agree to our success-based fee structure, which becomes payable upon the successful hiring of a candidate introduced through our platform. All communications and hiring processes must be managed through the platform until an official offer is extended.
4. Services for Talent
Talent can create an anonymous profile to showcase their skills and experience to prospective employers. You control which companies see your full profile. You agree not to misrepresent your skills, experience, or qualifications. There is no fee for talent to use our platform.
5. Fees and Payment Terms
Our platform operates on a success-based fee model for companies. The specific fee is a percentage of the hired candidate's first-year base salary, as outlined in the service agreement. Fees are due within 30 days of the candidate's start date. All payments are non-refundable.
6. Intellectual Property Rights
All content on the LeetHire platform, including text, graphics, logos, and software, is the property of LeetHire or its licensors and is protected by copyright and other intellectual property laws. You may not use any of our intellectual property without our prior written consent.
7. Confidentiality & Data Privacy
We are committed to protecting your privacy. Our collection and use of personal information are governed by our Privacy Policy. Both parties agree to maintain the confidentiality of any proprietary information shared through the platform.
7a. Candidate Privacy Protection
Core Commitment: LeetHire is built on a foundation of candidate confidentiality. We understand that many candidates are employed while job searching, and protecting their current employment status is paramount.
Company Obligations
By using LeetHire, Companies explicitly agree to the following legally binding obligations:
- Non-Disclosure: Companies shall never disclose candidate information to any third party, including but not limited to recruiters, HR networks, other employers, or any professional contacts.
- Current Employer Protection: Companies are strictly prohibited from disclosing any candidate information to the candidate's current or former employer, directly or indirectly.
- Internal Use Only: Candidate information may only be used for the purpose of evaluating the candidate for open positions within your organization and may not be shared beyond the hiring team directly involved in the recruitment process.
- No Data Harvesting: Companies may not download, copy, or store candidate information outside of the LeetHire platform without the candidate's explicit written consent.
Data Retention & Deletion
Candidate data accessed by Companies is subject to the following retention policies:
- Companies must delete any candidate information within 30 days of declining a candidate or having their application rejected.
- Candidates have the right to request immediate deletion of their data from any Company at any time.
- Upon a deletion request, Companies must confirm deletion within 7 business days.
Breach Consequences
Violation of these candidate privacy provisions may result in:
- Immediate termination of platform access
- Liability for actual damages suffered by the candidate
- Statutory damages of up to $10,000 per breach
- Legal fees and costs incurred by LeetHire or the affected candidate
- Reporting to relevant regulatory authorities where applicable
Candidate Rights
Candidates using LeetHire have the following rights:
- Blocklist Control: Candidates may block any company from viewing their profile, including their current employer.
- Progressive Disclosure: Candidates control when and to whom they reveal their full identity.
- Access Logs: Candidates can view which companies have accessed their profile.
- Breach Reporting: Candidates may report suspected privacy breaches to our Trust & Safety team.
8. Termination of Service
We may terminate or suspend your account and access to the services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. You may terminate your account at any time by contacting our support team.
9. Disclaimers & Limitation of Liability
The service is provided on an "AS IS" and "AS AVAILABLE" basis. LeetHire makes no warranties, express or implied, regarding the service. In no event shall LeetHire be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, or other intangible losses.
10. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the jurisdiction in which our company is incorporated, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved through binding arbitration in the same jurisdiction.
11. General Provisions
These Terms constitute the entire agreement between you and LeetHire concerning our services. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect. We reserve the right to modify these terms at any time.
